Welcome, and thank you for choosing SAL RESORT. These Terms and Conditions (the “Terms”) govern your access to and use of our website, products, and services offered by SAL RESORT. By browsing, shopping, or otherwise using our site (at www.salresort.com) you agree to these Terms. If you disagree with any part of these Terms, please do not use our site or purchase from us.

DEFINITIONS

  • “You” / “Customer” / “User” means the person who visits or uses the site, or purchases products.
  • “Products” means any item offered for sale on the site.
  • “Policies” refers to our separate policies: Privacy Policy, Shipping Policy, Returns & Exchange Policy, etc.
  • “Agreement” means these Terms together with the Policies.

 

ACCEPTANCE OF TERMS

  • By using the website or purchasing Products, you confirm you have read, understood and accept the Terms and the Policies.
  • If you do not agree to these Terms or any part of them, you must not use, or continue to use, the site or make purchases.
  • We may update the Terms at any time. When we do, the revised Terms will be posted on the website with a new “Effective Date.” Your continued use of the site after changes are posted means you accept those changes.

 

AGE & ELIGIBILITY

  • To make a purchase, you must be 18 years or older, or have parental/guardian permission if under 18.
  • Purchases are for personal, non‑commercial use, unless you have agreed otherwise with us (for example in a wholesale or other agreement).

 

ORDERING, PAYMENT & PRICING

  • When you place an order, you’re making an offer to buy Products under these Terms. We accept your order when we dispatch the Products.
  • Payment must be made at the time of checkout, using payment methods available on the site (credit card, Afterpay, PayPal, etc.).
  • All prices on the site are in AUD, unless otherwise stated. For international customers, conversion rates and/or bank fees may apply.
  • Prices include any applicable Goods and Services Tax (GST) or equivalent in Australia (if applicable). For export/international orders, any import duties, taxes, or customs fees are the responsibility of the Customer.
  • We reserve the right to change prices, promotions, and Product offerings at any time, including after an order is placed, but we will notify you if there are price changes that affect your order and give you the option to cancel.

 

SHIPPING, DELIVERY & RISK

  • Shipping costs, carriers, and delivery estimates are outlined in our Shipping Policy.
  • Once we hand over a Product to a carrier for dispatch, the risk passes to you.
  • Ownership/title in the Product transfers to you upon us receiving full payment.
  • We attempt to meet estimated delivery times but cannot guarantee them. Delays due to couriers, customs, weather, or other external events are outside our control.

 

RETURNS, EXCHANGES, FAULTY PRODUCTS

  • Our Returns & Exchanges Policy (linked separately) governs what you can return, exchange, the time window, condition of Products, etc.
  • Faulty or incorrect Products: if you receive something that is damaged or not what you ordered, please contact us immediately (with photos if possible), and we will arrange repair, replacement or refund as appropriate.
  • “Change of mind” returns are accepted if: within 14 days of delivery, Product is unused, in original packaging, tags attached]
  • Return shipping costs for change of mind are usually borne by the Customer unless otherwise stated (or unless the Product was faulty).

 

PROMOTIONS, GIFT CARDS & VOUCHERS

  • Promotional codes, sales, or discounts are subject to specific terms. Unless otherwise stated, codes cannot be combined.
  • If an order using a gift card is cancelled or returned, the portion of the sale paid for via the gift card will be restored as credit, according to the gift card or credit policy.

 

PRE ORDERS & CANCELLATIONS

If you offer pre‑orders or allow cancellations:

  • Pre‑order Products will be clearly marked. Payment is taken at time of order, even though the Product ships later.
  • We will notify you of the expected dispatch date. Delay notices will be provided when possible.
  • Cancellation by Customer before dispatch may be permitted; after dispatch, cancellation is generally not possible, unless required by law.
  • If we cancel an order before dispatch (other than for reasons due to you), we will refund in full.

 

INTELLECTUAL PROPERTY & USE OF CONTENT

  • All materials on the site (images, text, logos, designs, graphics, etc.) are owned by SAL RESORT or its licensors, protected by copyright, trademark, design laws and other intellectual property rights.
  • You get a limited license to view and use them for personal, non‑commercial use only. You must not copy, reproduce, modify, distribute or otherwise exploit the contents without our express written permission.
  • If you submit any User Content (reviews, photos, etc.), you grant us a non‑exclusive, worldwide, royalty‑free license to use, display, adapt or publish those in marketing, social media, or any other media. You represent that you have rights to do so.

 

USER OBLIGATIONS & CONDUCT

  • You agree to provide truthful, accurate, current information (address, payment, contact details, etc.).
  • You must follow all care instructions for Products; misuse may void returns or warranties.
  • You must use the site lawfully. Don’t upload harmful code, viruses, do anything to disrupt the site.
  • Don’t impersonate others, nor infringe on others’ rights.

 

LIMITATION OF LIABILITY / DISCLAIMERS

  • The Products are provided “as‑is” to the extent permitted by law. Unless legally required, we disclaim all warranties (implied or explicit) of merchantability, fitness for a particular purpose etc.
  • We are not liable for indirect, incidental, special, punitive or consequential damages (including loss of income, data etc.).
  • Our liability for any claim arising in connection with a product or the Agreement is limited to the amount you paid for the relevant Product.

 

INDEMNITY

You agree to indemnify, defend, and hold harmless SAL RESORT, its officers, employees, agents and partners from and against any and all claims, losses, liabilities, damages, costs or expenses (including legal fees) arising from your breach of the Terms, misuse of the site, or infringement of third party rights.

 

EXTERNAL LINKS & THIRD PARTIES

  • The site may contain links to third‑party websites or services (payment processors, shipping, etc.). These are for your convenience; we’re not responsible for those third parties’ practices, content, or reliability.
  • If you access external sites, you do so at your own risk.

GOVERNING LAW & DISPUTE RESOLUTION

  • These Terms are governed by the laws of Queensland, Australia.
  • You agree that any disputes will be in a court of competent jurisdiction in Queensland (or relevant jurisdiction).
  • If applicable, include arbitration or small claims procedures (optional).

 

FORCE MAJEURE

We will not be liable or responsible for delays or failures in performance (shipping etc.) arising from causes beyond our reasonable control: natural disasters, government acts, pandemics, shortages, delays etc.

 

SEVERABILITY, WAIVER & ASSIGNMENT

  • If any part of these Terms is found invalid or unenforceable, that part will be severed, and the rest remains in effect.
  • A failure to enforce a right is not a waiver of that right.
  • We may assign or transfer our rights under these Terms at our discretion; you cannot without our written agreement.

 

NOTICES

  • We may send you notices, including changes to Terms, via email (using the address you provide), or by posting on the website.
  • Such notices are effective when sent or posted.
